CODE OF ETHICS FOR DIGITAL NEWS WEBSITES<\/span> <\/span>
\r\n<\/span><\/span>
\r\n\u00a0The Digital News Publishers Association has voluntarily drawn up a Code of Ethics <\/span>
\r\nfor its members as outlined below, which demonstrates their commitment to <\/span>
\r\nresponsible digital publishing <\/span>--<\/span>even as it, in <\/span>order to protect our 19 (1) (a) and <\/span>
\r\nother Constitutionally mandated freedoms, keeps under review and scrutinizes any <\/span>
\r\ndevelopments likely to restrict the gathering and dissemination of news and <\/span>
\r\ncurrent affairs or any other content.<\/span> <\/span><\/span>
\r\nThe object of this Code i<\/span>s to outline high standards, ethics and practices in digital <\/span>
\r\nnews publishing, and does not constitute any attempt to involve itself in the day to <\/span>
\r\nday operations of the publishers <\/span>--<\/span>who have complete editorial and content <\/span>
\r\nindependence.<\/span> <\/span><\/span>
\r\n<\/span><\/span>
\r\nThe basic precepts o<\/span>f the Code of Ethics are to maintain the standards of digital <\/span>
\r\npublishing as well as protect and maintain the independence of journalists, content <\/span>
\r\nentities and publishers.<\/span> <\/span>
\r\n<\/span>
\r\n1.<\/span> Digital <\/span>news <\/span>websites <\/span>follow <\/span>the <\/span>laws <\/span>of <\/span>the <\/span>land <\/span>including <\/span>the <\/span>
\r\nConstitution of Indi<\/span>a, the over 30 laws relating to the media, relevant <\/span>
\r\nprovisions of IPC, CrPC as well as the Information Technology Act, <\/span>
\r\n2000, where applicable.<\/span> <\/span>
\r\n<\/span>
\r\n2.<\/span> They also diligently adhere to accepted norms of journalistic ethics and <\/span>
\r\npractices and maintain the highest stan<\/span>dards of professional conduct. <\/span>
\r\nThere are several layers of these self<\/span>-<\/span>regulatory ethics and codes <\/span> \u2013<\/span>
\r\nincluding as outlined by specific entities as well as rigorous processes <\/span>
\r\nin newsrooms at the level of <\/span>journalists and editors.<\/span> <\/span>
\r\n<\/span>
\r\n3.<\/span> Accuracy, Transparency & Fair<\/span>ness<\/span> <\/span>
\r\nMembers should eschew publication of inaccurate, baseless or <\/span>
\r\ndistorted material. Pre<\/span>-<\/span>publication verification should be mandatory. <\/span>
\r\nDefamation should be avoided. Adherence to applicable laws and <\/span>
\r\nrules is necessary.<\/span> <\/span>
\r\n<\/span>
\r\n4.<\/span> Right of reply<\/span> <\/span> a.<\/span> News reports and arti<\/span>cles should incorporate comments or version of <\/span>
\r\nperson or party in respect of whom allegations are carried.<\/span> If not carried, <\/span>
\r\nthe person or party\u2019s response, if received later, to be incorporated.<\/span> <\/span>
\r\nb.<\/span> If there are developments in the news, and the concerned pers<\/span>on or party <\/span>
\r\nrequests an update, the same must be carried appropriately. Date of <\/span>
\r\nupdate should also appear in the news item published.<\/span> <\/span>
\r\n<\/span>
\r\n5.<\/span> Take down, delete or edit<\/span> <\/span>
\r\nIf news report or article is found to contain false <\/span>or inaccurate<\/span> information<\/span>, <\/span>
\r\nthen on approach by the concerned person or party, providing correct <\/span>
\r\ninformation, identifying himself or herself, providing required<\/span> documents or <\/span>
\r\nmaterial, the portion of the ne<\/span>ws report or article should be edited or <\/span>
\r\ndeleted. <\/span> <\/span>
\r\n<\/span>
\r\nIf entire news report is found to contain false, inaccurate<\/span> information<\/span>, the <\/span>
\r\nentire article should be deleted.<\/span> <\/span>
\r\n<\/span>
\r\n6.<\/span> Respect Intellectual Property Rights<\/span> <\/span>
\r\na.<\/span> Copyright in text, photographs, plans, diagrams, cartoo<\/span>ns, etc must be <\/span>
\r\nrespected.<\/span> If copyrighted material is used, then prior permission <\/span>
\r\nshould <\/span>be <\/span>taken <\/span>and <\/span>publication <\/span>must <\/span>acknowledge <\/span>moral <\/span>and <\/span>
\r\nownership rights. <\/span> <\/span>
\r\nb.<\/span> If permission requires payment of fee or royalty, the same must be paid.<\/span> <\/span>
\r\nc.<\/span> Trade Marks and Servic<\/span>e Marks of third parties not to be used except <\/span>
\r\nwith prior permission or if such use constitutes fair use. <\/span> <\/span>
\r\nd.<\/span> In case infringement of intellectual property <\/span> \u2013<\/span> upon receiving any <\/span>
\r\nrequest and after getting the necessary documents<\/span>,<\/span> the concerned <\/span>
\r\ncontent should be<\/span> edited, deleted or take down if necessary.<\/span> <\/span>
\r\n<\/span>
\r\n7.<\/span> Care <\/span>to <\/span>be <\/span>taken <\/span>for <\/span>reporting <\/span>sensational <\/span>matters <\/span>and <\/span>crime. <\/span>
\r\nPresumption <\/span>of <\/span>innocence <\/span>must <\/span>be <\/span>preserved. <\/span>Comments <\/span>and <\/span>
\r\nspeculation on evidence, witness and witness conduct, accused and <\/span>
\r\nvictim and their respectiv<\/span>e conduct to be avoided. Such reporting <\/span>
\r\nshould be based on facts and unbiased. <\/span> <\/span>
\r\n<\/span>
\r\n8.<\/span> Special care to be taken while reporting on sexual harassment in <\/span>
\r\nworkplace, child abuse, rape, where accused or victims are minors, <\/span>
\r\nmatrimonial, riots and communal disputes \/ <\/span>clashes, divorce and <\/span>
\r\ncustody cases, adoption matters, etc.<\/span> <\/span>
\r\n<\/span> \u2022<\/span> Care to be taken, to follow Sections 67, 67A and 67B of the Information <\/span>
\r\nTechnology Act, 2000 where applicable <\/span> --<\/span> which provide for penalties for <\/span>
\r\npublishing or transmitting obscene <\/span> material, sexually explicit material and <\/span>
\r\nalso material depicting children in sexually explicit acts, in electronic form. <\/span> <\/span>
\r\n<\/span>
\r\n9.<\/span> Grievance Redressal Mechanism<\/span> <\/span>
\r\nMembers <\/span>\u2013<\/span>when intermediaries as defined under the Information Technology Act, <\/span>
\r\n2000<\/span>\u2014<\/span> follow the grievan<\/span>ce redressal mechanism as outlined therein and are <\/span>
\r\ncognizant of the liabilities and safe harbor protections under Section 79 of the IT <\/span>
\r\nAct<\/span> 2000. Hence, as relevant, they follow the Information Technology <\/span>
\r\n(Intermediary Guidelines) Rules, 2011 including appo<\/span>inting a grievance officer <\/span>
\r\nwhose contact details are displayed on the website <\/span>and <\/span>who acts within 36 hours of <\/span>
\r\nreceipt of complaint by affected person and redresses the complaint within one <\/span>
\r\nmonth from its receipt.<\/span> <\/span>
\r\n<\/span>
\r\n10.<\/span> Training and Awareness Programs<\/span> <\/span>
\r\nConduct <\/span>periodic <\/span>training <\/span>and <\/span>awareness <\/span>programs <\/span>with <\/span>editorial <\/span>staff <\/span>about <\/span>
\r\nexisting laws including Constitution of India, the over 30 laws relating to the media <\/span>
\r\nlike The Indecent Representation of Women (Prohibition) Act, Copyright Act, Right <\/span>
\r\nto Informati<\/span>on Act, relevant provisions of Indian Penal Code and CrPC, civil and <\/span>
\r\ncriminal defamation, IPR, Juvenile justice, POCSO, relevant provisions relating to <\/span>
\r\nreporting on rape and molestation, harassment in the work place, caste or gender <\/span>
\r\nrelated crime, domestic<\/span> violence, etc. <\/span> <\/span>
\r\no<\/span> Names of victims and details leading to identification of victims <\/span>
\r\nor perpetrator, if juvenile or in the workplace, to be strictly <\/span>
\r\navoided.<\/span> <\/span>
\r\no<\/span> Photographs of victims, their residence, workplace, etc to be <\/span>
\r\navoided.<\/span> <\/span>
\r\no<\/span> Special care and caution mu<\/span>st be exercised at all times while <\/span>
\r\nreporting <\/span>matters <\/span>related <\/span>to <\/span>communal <\/span>or <\/span>religious <\/span>
\r\ndisputes\/clashes. Such news items shall be published only after <\/span>
\r\na proper verification of facts and should be presented with due <\/span>
\r\ncaution and restraint, ensuring an environ<\/span>ment that is conducive <\/span>
\r\nto promoting communal harmony, amity and peace.<\/span> <\/span>
\r\no<\/span> Special care in reporting on Courts and judicial matters.<\/span> Create <\/span>
\r\nawareness among editorial staff <\/span>about legislative privileges<\/span> and <\/span>
\r\ncorrect reporting of Court hearings, judicial matters,<\/span> etc. To <\/span>
\r\nensure that versions of victim and accused are covered, without <\/span>
\r\ncomments thereon.<\/span> <\/span>
